Family sues over 5-year-old son's death at Sun Dial

The family of a 5-year-old North Carolina boy died from injuries he received at a rotating restaurant 72 stories above Downtown Atlanta has filed a lawsuit against that establishment.

Charlie Holt was visiting Atlanta’s iconic Sun Dial restaurant at the top of the Westin Peachtree Plaza Hotel along with his family for lunch on April 14 when he became pinned between a stationary part of the restaurant and a rotating part. It took rescue crews about 30 minutes to free Holt from a 4-inch gap along the line of rotation.

The initial cause of death was ruled a "crush injury of the head and brain," according to the Fulton County Medical Examiner. The manner of death was ruled an "accident" by the medical examiner as well.

In a statement, the Holt family said there were no emergency stop buttons and no safeguards to prevent someone from getting trapped.

The Holt family was visiting from the Charlotte area.
