Family of Chicago man shot by off-duty cop claims parts of surveillance video missing

CHICAGO (FOX 32 News) - The family of a man who was shot and killed by an off-duty Chicago police officer wants to know why key portions of a video are missing.

On Friday, attorneys for Marlon Horton’s family were in court seeking access to the videos without having to get them from police.

The video shows Marlon Horton outside a Chicago housing authority building where he was shot and killed by a security guard three years ago. Horton became agitated when guards denied him access to the building to see his girlfriend.

The guard who shot him was an off duty Chicago police officer who claimed Horton lunged for his weapon. Horton's family claims the video shows otherwise, but they are concerned that on some of the cameras, video is missing.

“We have twenty minutes directly at the time of the shooting that was not given to us,” said attorney Jeffrey Granich.

Three CHA security cameras recorded the incident. The family's attorneys say two of the DVDs they've received from Chicago police have unexplained gaps. On Friday, a federal judge told them to keep working with the police, but they're hoping to go directly to the source of the video.

“We want to go to the actual CHA server and get the direct video from those cameras to see where those twenty minutes of video are,” Granich said.

The family attorneys say filling in those gaps may help answer some questions, but regardless, they are already satisfied that the shooting of Marlon Horton was not justified.
