Man who says he was beaten on flight files lawsuit against airline

An elderly man who says he was beaten and dragged on a flight to O’Hare is going to battle against the airline saying he wants justice.

The airline and the family are both standing by their accounts of what happened. But the family says they are ready for a fight.

74-year-old David Ukesone says he's doing better since his ordeal on a United Arab Emirates flight when he was restrained and he says dragged and beaten by the flight crew. But David and is family are fighting back.

“My father will not be kept in this condition and will not allow all this incident to be swept under the rug,” said Emmanuel Ukesone.

They hired a high-profile attorney who says the airline was out of line and David has a strong case given that there is no police report.

"If it is true that he was unruly on the plane, if that's true, unruly to the point that he was restrained for 8 hours, I would expect there would be a police report,” said Howard Schaffner.

The airline is doubling down, telling FOX 32 in a statement that David "disturbed other passengers…assaulted crew and bit another passenger."

David got emotional as we read those claims to him on Tuesday.

"That's terrible. I cannot. I didn't hurt nobody. I didn't come over and fight too. I didn't. It's just the airline against me,” David said.

"My father has never been for any reason involved in any criminal theft or any kind of misbehavior,” Emmanuel said.

The attorney is hoping that someone on the plane took video of the incident so that his client will have his innocence proven. David wants that as well.

The attorney says with all those people on that flight and given how violent this incident clearly was, someone had to take some cell phone video of it. It's just a question of whether anyone will come forward.
