Man accused of raping 85-year-old woman with dementia

A Rockville man is behind bars after police say he raped a friend’s 85-year-old mother who suffers from dementia in a Montgomery County home in mid-March. 

According to court documents, the woman was visiting Holy Cross Hospital in Germantown on March 14 for a checkup after a fall when medical staff noticed signs that she may have been sexually assaulted while they were changing her clothing.

Nurses asked the woman what happened to her and she stated “someone visited her and had sexual intercourse with her after she told him ‘no.’” Court documents say the woman would not identify the person by name but told nurses “he was a friend of her son.” 

After speaking with the woman, medical staff contacted police and adult protective services. 

During an investigation, the woman told police “a man came and kissed her” at her home and “that was a real bad time.” She then told authorities he had sex with her without her consent. Court documents say the woman was initially afraid to say the name of the man who raped her. 

The woman’s son, who had taken her to the hospital, resides with and is the sole caregiver of his mother. He told police his friend, 62-year-old Michael Eubanks, visited their Germantown home for dinner on March 12.

The woman’s son says he left the home for around 30 minutes to pick up food, leaving his mother and Eubanks alone. 

Court documents say the woman’s son and Eubanks had previously had a falling out in 2012 or 2013 after Eubanks had kissed his wife and his mother without their consent. They had recently reconnected prior to this incident. 

On March 15, police stopped Eubanks while he was driving in the area of Maycrest Way in Germantown and took him into the station for questioning. During this time, police say Eubanks admitted to engaging in sexual activity with the woman and said “he knew it was wrong” citing that he was aware that she suffered from dementia and is unable to make informed decisions. 

Eubanks was arrested and transported to the Central Processing Unit. 

He has been charged with second-degree rape, vulnerable adult abuse with physical injury and second-degree assault.
