Cook County felon denied pre-trial release after robbery, stolen gun found: officials

A Cook County man accused of robbing a grocery store and storing a stolen, loaded handgun in his vehicle was denied pre-trial release.

What we know

Davares Kinsey, 33, appeared in court Saturday morning on several charges:

  • One count of unlawful possession of a firearm by a repeat felony offender (Class X felony) 
  • One count of unlawful possession of a weapon by a felon (Class 2 felony)
  • One count of aggravated unlawful use of a weapon (Class 2 felony)
  • One count of misdemeanor retail theft

His charges stem from a retail theft that occurred at 2:18 p.m. Friday involving a 2017 black Chrysler Pacifica, according to the DuPage County State's Attorney.

A short time later, Kinsey entered the vehicle, drove to a Jewel grocery store, and went inside. 

After selecting 14 items, he went to the self-checkout, paying for some but not all of the items, which were valued at $140. Authorities said Kinsey was leaving the store with all the items when Elmhurst police arrested him.

While searching his vehicle, officers found a loaded 9mm handgun in the center console. The weapon was reported stolen out of Chicago, according to the state’s attorney.

"Armed felons who come to our community to commit crime will not be tolerated by the hardworking officers of the Elmhurst Police Department," Elmhurst Chief of Police Michael McLean said. "I am grateful for the proactive efforts of our police officers and to State’s Attorney Bob Berlin for prosecuting dangerous weapon offenders to the fullest extent of the law."

What's next in the case 

Kinsey will remain in jail until his next court appearance, scheduled for Feb. 2.

Further details on his possible sentencing and the case haven't been released.
